Jessica M. Lynch’s practice focuses on regulatory matters, including proceedings involving electric power and natural gas markets and rates, as well as energy sector transactions, including the representation of project developers, energy traders, financial institutions and electric utilities.
Jessica routinely advises clients on the requirements of the U.S. Federal Power Act (“FPA”), the U.S. Natural Gas Act, the U.S. Energy Policy Act of 2005, the U.S. Public Utility Holding Company Act, the U.S. Public Utility Regulatory Policy Act and other federal rules and regulations affecting the energy sector.
She also regularly advises project developers on energy market and regulatory matters, including gas pipeline interconnection and lateral services, electric interconnection, generating capacity market participation and transmission rights.
Jessica represents clients in a variety of U.S. Federal Energy Regulatory Commission (“FERC”) hearings, settlements and rulemaking and enforcement proceedings.
She assists clients seeking to obtain and retain regulatory authorizations for market-based rate authority, including preparation of updated market power analyses and notices to comply with changes in status obligations, as well as to maintain qualifying facility, exempt wholesale generator and foreign utility company statuses.
Representative Matters :
- Bayonne Energy Center, LLC (BEC): Lead associate representing the BEC, a 500 MW brownfield project owned by Hess Corporation and ArcLight Capital Partners in Bayonne, NJ. This representation includes obtaining transmission rights and incremental transmission congestion contracts and successful litigation of exemption from New York Independent System Operator, Inc. (“NYISO”) buyer-side mitigation rules and associated FERC proceedings.
- GE EFS, Linden VFT: Lead associate on various FERC proceedings for Linden VFT, a 315 MW merchant transmission facility in between NYISO and PJM.
- Advised a public utility in upstate New York on various issues associated with receiving energy delivered from PJM.
- Represents electric cooperatives and municipal utilities in several transmission rate proceedings (both stated rate and formula rate) before FERC.
- Represents clients in non-public FERC Office of Enforcement (“OE”) proceedings by responding to data requests, preparing witnesses for depositions and engaging in settlement discussions with OE staff.
- Represents several clients in due diligence reviews for proposed acquisition and disposition transactions; drafted related applications for FERC authorization under FPA section 203.
