John M. Bowler’s practice focuses on Intellectual Property litigation. He is a first-chair trial attorney with over twenty-three years’ experience in major cases in federal and state trial and appellate courts.

He has represented a variety of corporations throughout the United States, and is a veteran of litigation and strategic counseling involving a wide range of substantive issues.

John’s practices touches almost every aspect of intellectual property, allowing him to address the full breadth of his clients’ litigation and counseling needs and to navigate amongst competitors’ intellectual property rights.

John’s trial experience includes jury trials, bench trials, arbitrations, and contested evidentiary and injunction hearings ranging from cases for Fortune 500 clients, to large international concerns, to closely-held businesses and individuals.

He also has extensive experience with opposition and cancellation proceedings before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office, as well as all aspects of domain name and ICANN’s Uniform Dispute Resolution Policy practice before administrative panels and other tribunals.

John represents clients in a wide range of diverse industries, including consumer and industrial products, sports equipment, apparel and footwear, automotive and other industrial machines, computer and electronics, energy and utilities, telecommunications, medical devices, financial services, textiles, the Internet, media and entertainment, news and information providers, publishing, real estate, restaurant chains and food distributors, retail and discount operations, staffing services, surveying and measurement, universities and research organizations, injection molding, event production and fundraising, games and toys, lottery and gaming, fastening and architectural products, and artwork (visual, sound, and literary), among others.

Representative Matters :

  • Pro Sports USA v. Mizuno USA. Lead trial counsel to international sporting goods company in defense of patent infringement action involving golf irons; defeated plaintiff’s motion for preliminary injunction and its infringement suit on summary judgment. Obtained a jury verdict of patent invalidity on client’s declaratory judgment counterclaim; successfully argued for affirmance in the Federal Circuit.
  • Adco International v. Atlanta Snapseal. Lead trial counsel to defendant manufacturer of patented cap seal for chemical drums accused of unjust enrichment, unfair competition and breach of contract. Plaintiff sued for $3 million in damages. Defeated most of plaintiff’s claims on summary judgment and obtained a jury verdict for client on all remaining claims.
  • John Mezzalingua d/b/a PPC v. Antec Corp. Represented telecommunications equipment manufacturer accused of design patent infringement in Florida district court. The jury found coaxial cable connector product infringed, which verdict was upheld by Federal Circuit. Client successfully designed around patent during appeal and continued to sell product.
  • Birmingham Softhands v. Mizuno USA, Inc. Successfully defended sporting goods manufacturer against $10 million trademark/unfair competition claims; district court granted summary judgment dismissing plaintiff’s damages claims against client; favorable settlement reached on remaining issues.
  • Banco de Brasil v. BB Credit Transfer. Represented largest bank in Brazil in obtaining a temporary restraining order and preliminary and permanent injunctions on trademark infringement claims against money transfer company.
  • Kimberly-Clark Corp. v. Neely. Lead trial counsel to international manufacturer of synthetic fiber products in trade secret action against its former scientist; obtained temporary restraining order and preliminary and permanent injunctions.
