Mr. Joseph J. Kagan manages litigation matters, specifically in the areas of premises liability, product liability, transportation and bankruptcy.
As an Associate Attorney, he analyzes and develops litigation strategies through factual investigation and communication with clients; prepares and argues motions; takes and defends depositions; participates in mediations and other settlement conferences; and prepares clients in civil trials.
Mr. Kagan has successfully defended individuals, local companies and large corporations in state and federal courts from inception of litigation through trial; and has prepared, argued, and won a number of key demurrers and summary judgment motions on behalf of clients.
He has defended cases brought against product manufacturers, transportation companies, and premises liability owners including national and international product manufacturers, interstate motor and air carriers, and national retail stores, restaurants and hotels/resorts.
He also has successfully litigated bankruptcy adversary cases on behalf of individuals and business entities, both as debtors and creditors.
Before becoming an Associate, Mr. Kagan was a Clinical Intern at Higgs and, following his graduation in April 2015, was promoted to Post-Bar Law Clerk where he was immediately put to work assisting in the defense of a three-week traumatic brain injury trial.
He also conducted a wide range of legal research, drafted numerous research memoranda, and supported attorneys in several civil and bankruptcy proceedings, as well as creditor meetings.
Mr. Kagan earned his Bachelor of Arts in Political Science with a Minor in Spanish from the University of Arizona, and received his Juris Doctor from California Western School of Law, graduating with the Academic Excellence Award in Alternative Dispute Resolution. He was also a member of the Public Service Honors Society.
