Justin N. Mullen has a diverse patent practice that includes patent litigation before district courts and the U.S. International Trade Commission (ITC), client counseling, and patent prosecution. He has significant experience developing infringement and invalidity positions, as well as implementing litigation strategies through claim construction and expert discovery.
Justin represents clients across a range of technical issues, with particular emphasis on cellular LTE and 5G technologies, such as those related to resource allocation, the physical layer, and the control plane. He also has significant experience working with television and media technologies, such as video processing and compression.
Justin has experience in all phases of patent litigation from inception through trial, including managing discovery and source code review, assisting technical experts, preparing witnesses for deposition and trial, drafting pretrial motions, and arguing motions.
He represents both patent owners and petitioners before the Patent Trial and Appeal Board (PTAB). He has experience developing preliminary response strategies for patent owners resulting in institution denials, as well as drafting inter partes review (IPR) petitions.
Justin’s patent prosecution work ranges from managing large international patent portfolios to developing patent strategies for early-stage startup companies. He works with teams of attorneys and technical specialists to implement portfolio development strategies, including obtaining standard-essential patents.
He also counsels clients on strategically developing intellectual property assets to protect their technical competitive advantages. Over the years, Justin has personally drafted and prosecuted hundreds of utility and design applications.
He also has significant experience prosecuting patent applications before the European Patent Office (EPO), including coordinating prosecution between copending U.S. and European applications.
Justin has a diverse technical foundation from his work before joining Finnegan. He served as a patent examiner at the U.S. Patent and Trademark Office (USPTO) for four years. His work there related to multiplex networking, including Voice over IP (VoIP).
During his undergraduate studies, Justin worked with a solar panel manufacturer in the research and development of thin-film solar cells and mechanical heat engines. As part of his electrical engineering coursework, he completed projects related to network architecture, power electronics, and electric vehicles.
