
M. Kaylan Dunn is an Associate in the Litigation section of the Houston office. Her practice covers the spectrum of commercial litigation with an emphasis on oil and gas, banking, insurance, construction, and real estate disputes, as well as probate and fiduciary litigation. She has successfully represented wide-ranging clients in matters involving breach of contract, negligence, fraud, breach of fiduciary duty, trespass, and other torts.
In her probate and fiduciary litigation practice, Kaylan has represented fiduciaries and beneficiaries in multimillion-dollar lawsuits involving executors, trustees, guardians, and other fiduciaries. She has represented clients in will contests, will and trust interpretation issues, guardianships, cy pres matters, and prosecution and defense of various fiduciary claims.
In her civil litigation practice, Kaylan served as trial co-counsel in a multi-million dollar fraud and breach of contract dispute regarding stock option valuation for a technology start-up company, which resulted in an extremely favorable settlement for the client mid-trial.
Kaylan’s also experience includes assisting in the successful defense of one of the nation’s largest banks in a $47.5 million suit for wrongful foreclosure of collateral where she drafted motion and trial briefs, reviewed documents and helped with the preparation of witnesses for trial.
Kaylan is currently assisting in the representation of a major shale gas producer in a federal putative class action involving saltwater disposal wells and the alleged migration of injected hydraulic fracturing fluids. She has also successfully represented various oil and gas clients in royalty, equipment fabrication, and land disputes.
Kaylan successfully represented the Houston SPCA as an applicant in a cy pres matter filed by the Texas Attorney General’s office seeking modification of a charitable trust and distribution of funds in excess of $1.8 million for the construction of an animal rescue facility.
The SPCA was among six animal protection organizations seeking receipt of the trust funds and, after a lengthy hearing, was deemed the sole recipient of such funds.
Kaylan is also the lead associate on the firm’s team that represents a trust protector in a multi-million dollar trust dispute pending in The Netherlands.
