Kelly Eberspecher is a seasoned first-chair intellectual property litigator who represents clients in district courts throughout the country and in proceedings before the Patent Trial & Appeal Board. In Post Grant Proceedings alone, he currently serves as lead counsel in nearly a dozen active matters and has established a high institution rate when challenging patents.
Kelly’s practice spans a broad range of technical realms, including electrical and software technologies, medical devices, chemical compositions, mechanical methods and devices, and pharmaceuticals. He litigates a variety of trademark matters arising under the Lanham Act, as well as cases involving trade secrets and copyrights.
In addition to his demanding legal practice, Kelly is a respected National Institute of Trial Advocacy instructor and has served on committees for the American Bar Association Intellectual Property Section.
In recognition of his leadership in the field, Kelly has been named a Leading Lawyers Network Leading Intellectual Property Lawyer on numerous occasions and has been listed in Illinois Super Lawyers for intellectual property litigation every year since 2010.
Additionally, he is a veteran of the US Navy where he served as a SEAL team member conducting special operations.
