Kelsey Miller provides counsel to hospitals, physician groups, and other health care providers and stakeholders on the full spectrum of legal health care matters. A member of both the Health Care Section and the Data Protection and Cybersecurity Team at Williams Mullen, she focuses on the various Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) requirements related to privacy, security and breach notification.
Kelsey has guided clients through the breach notification process following a data breach, and she regularly advises on HIPAA permitted uses and disclosures, business associate agreements and policies and procedures.
She has worked with several clients evaluating and responding to CMS audits related to their Electronic Health Record (“EHR”) Meaningful Use attestation. Kelsey is the Editor of Williams Mullen’s Health Care Data Aware Blog, which highlights current events, news, and key legal and regulatory authorities and guidance related to health care data privacy and security.
Kelsey advises on various federal and state regulatory and compliance issues, including Certificate of Public Need (“COPN”), Stark Law and Anti-Kickback Statute analysis, and reimbursement and Medicare overpayment matters. She also helps providers that are regulated by the Board of Health Professions, the Department of Health or the Department of Social Services navigate investigations and potential adverse actions.
She also advises health care providers on contracting and contractual matters. She volunteers with and serves on the board of directors of the Richmond Animal League. Before joining Williams Mullen, Kelsey was an associate in the Health Care practice at Troutman Sanders.
Prior to that, she worked as a legal research assistant in Virginia’s Division of Legislative Services, assisting staff attorneys in the House of Delegates’ Committee on Health, Welfare, and Institutions and the Senate’s Education and Health Committee of the Virginia General Assembly, and handled FOIA requests and appeals for the Department of Health and Human Services.
Kelsey received her Juris Doctor, cum laude, from the University of Richmond School Of Law in 2012, where she served as lead articles editor for the Journal of Law and the Public Interest and volunteered with the Wills for Seniors Pro Bono program. She graduated from the University of Virginia with a B.A. in Psychology.
