Kevin Ashe advises clients on environmental and land use issues involved in the planning, financing and acquisition of large-scale development projects, including transportation projects, mixed-use developments, and renewable and traditional energy facilities.
Kevin routinely advises clients on issues arising under the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA), California Coastal Act, federal and California Endangered Species Acts, Clean Water Act and Porter-Cologne Water Quality Control Act, Resource Conservation and Recovery Act (RCRA) and California Hazardous Waste Control Laws.
In addition to his environmental practice, Kevin works with Pillsbury’s Real Estate practice group by drafting and negotiating purchase and sale agreements, residential and commercial leases, management agreements, 1031 exchange transactions, and securing and reviewing project entitlements.
Prior to joining Pillsbury, Kevin was an extern at the California Public Utilities Commission, California Attorney General’s Office (Natural Resources section); and the San Francisco Public Defender’s Office. Kevin continues to represent indigent clients in criminal record expungement cases on a pro bono basis.
REPRESENTATIVE EXPERIENCE :
- Represents San Francisco Bay Area Rapid Transit District (BART) on CEQA review and other environmental issues for the BART to Livermore Extension project.
- Represented California developer in the development, management, and sales of luxury condominium units in the 60-story, $680 million 181 Fremont project.
- Represented Chinese developer with environmental, land use and entitlements review in connection with its acquisition of a membership interest in the $5 billion Treasure Island Development project.
- Routinely advises solar and wind energy developers with due diligence and negotiating environmental issues involved in the development, sale, and acquisition or refinancing of renewable energy projects in California.
- Assisted in the representation of Western States Petroleum Association in defending writ petition brought under CEQA challenging Kern County zoning ordinance amendments for streamlined oil and gas permitting.
