Kristi L. McIntyre focuses her practice on complex patent litigation before U.S. district courts and the U.S. Court of Appeals for the Federal Circuit. She represents pharmaceutical patent holders in Abbreviated New Drug Applications (ANDA) litigations under the Hatch-Waxman Act and has been involved in all aspects of litigation, from the initial pleading stage through trial and appeal.
Kristi’s litigation experience includes developing infringement and validity strategies, preparing fact and technical expert witnesses, coordinating discovery, drafting a wide range of motions and briefs, taking and defending depositions, and handling day-to-day litigation activities.
Kristi is also involved in representing clients in post-grant proceedings before the U.S. Patent and Trademark Office (USPTO), including inter partes review (IPR) proceedings. Kristi’s practice covers a range of technologies, including matters involving complex issues concerning solid state forms (polymorphs), small molecules, paraffin compositions, and pharmaceutical formulations, including parenteral and oral.
While earning her undergraduate degree, Kristi conducted research on the structure and function of trypanosome membrane proteins. She also studied chemistry at University College London. Kristi’s pro bono experience includes representing clients before the U.S. Court of Appeals for Veterans’ Claims.
