Kris Woliver represents and counsels companies in all aspects of employment law, with a specialty in ERISA litigation. Kris serves companies ranging in size from several employees to thousands of employees worldwide. She regularly defends employers in litigation, including against age, race, sex and disability discrimination claims, along with retaliation, harassment and wrongful termination claims.
She has successfully resolved disputes from the charge and position statement stages through discovery and summary judgment. Kris also offers e-discovery expertise. Kris specializes in ERISA litigation. She has the unique ability to simplify complex benefits claim disputes and has successfully resolved such matters, along with related executive compensation disputes, throughout the Midwest and in North Carolina, New York and California.
Kris recently obtained a total victory in an ERISA top hat plan dispute in arbitration, saving the company approximately US$5 million. In addition to her litigation work, Kris provides counseling to clients in creating and implementing employment policies by staying up to date on hot topics affecting employers. On one such topic – arbitration in the employment context – Kris has experience under Ohio, Kentucky, Indiana and California law.
In addition, she is familiar with state-by-state wage and hour laws, with specific focus on wage deduction laws. Kris likewise stays current on best practices regarding restrictive covenants. She has both defended and pursued enforcement of non-compete, non-solicitation and confidentiality agreements. She attacks all breach and trade secret misappropriation matters with creativity, incorporating her knowledge of the inevitable disclosure doctrine and other statutory and common law.
While in law school, Kris served as the business editor for the Ohio State Law Journal. She also represented the Moritz College of Law in an official capacity by co-leading the Moritz Ambassador program. Kris earned the CALI Excellence award in Legal Research and Writing. While studying Economics and Spanish at The Ohio State University, she studied abroad in Toledo, Spain. Kris is a member of Phi Beta Kappa.
