Magnus Essunger is a litigator with extensive experience in all aspects of patent disputes. He has been to trial in federal district court several times in bet-the-company billion-dollar pharmaceutical Hatch-Waxman ANDA litigation.
Magnus focuses on the litigation and trial of complex patent cases in federal court, at the PTAB and in the ITC. He works on all phases of such litigation, from pre-litigation investigations to appeal, particularly on the development and analysis of key factual and legal issues, legal briefs, discovery, and expert reports.
He has substantial experience taking expert and fact depositions in ANDA litigation and has second-chaired several direct and cross-examinations at trial. Magnus has worked closely with some of the most prominent pharmaceutical expert witnesses.
While much of his work has been in the pharmaceutical and biotech areas, representative matters also include business method and green tech LED patent litigation, including logistically complex ITC proceedings against dozens of accused infringers.
Representative Matters :
- Secured a win at trial in ANDA litigations against certain generic manufacturers and a preliminary injunction against another on behalf of Indivior, relating to its billion-dollar opioid dependence treatment, Suboxone® Film.
- Achieved a rare complete win for inventor and Rensselaer professor E. Fred Schubert in inter partes review proceedings against a leading LED manufacturer, which was affirmed on appeal.
- Represented Life Technologies in a Section 146 district court action arising from patent office interference proceedings relating to single-molecule DNA sequencing.
