Mark A. Wagner concentrates his practice in employment law, homeowners association law, and health care law, and serves as Chair of the firm’s Employment and Labor Practice Group.
In his employment practice, Mr. Wagner counsels and represents employers in virtually all aspects of the employment relationship, including employee recruiting, screening, and hiring; executive employment agreements; employment handbooks, policies, and procedures; employee leave; minimum wage and overtime pay; drug and alcohol testing, medical exams, and genetic testing; employee privacy; occupational safety and health; workplace violence and theft; employee personnel files and employer recordkeeping; employment discrimination, harassment, and retaliation; and employee discipline and termination.
He also counsels and represents employers in connection with confidentiality, nonsolicitation, and noncompete agreements, trade secrets, and employment inventions; and defends employers in audits, investigations, and proceedings before numerous federal and state agencies and courts.
Mr. Wagner also counsels and represents homeowners associations, housing authorities, and other real property owners, landlords, tenants, and managers in a wide range of disputes, and in administrative and judicial proceedings under the Utah and federal Fair Housing Acts and the Americans with Disabilities Act.
Mr. Wagner also counsels and represents physicians and health care practices in connection with health-care law compliance, including under the Stark Law and Anti-kickback Statute, and in physician credentialing.
Mr. Wagner served as Law Clerk to the Honorable David K. Winder, Chief Judge of the United States District Court for the District of Utah.
After his clerkship, he practiced law as a shareholder at Parr, Waddoups, Brown, Gee & Loveless, and then as a shareholder at Van Cott, Bagley, Cornwall & McCarthy, where he also served as Chair of the firm’s Employee and Employee Benefits practice group.
