
Matthew Borah is a real estate attorney practicing primarily in the area of affordable housing. He also has broad experience in the areas of commercial real estate and real estate finance. Matthew represents for-profit and non-profit developers in the acquisition, financing, development and construction of affordable housing developments.
He also has experience in the acquisition and disposition of partnership interests in entities that own and operate affordable housing developments.
He has represented clients in transactions financed with low-income housing tax credits, HOME funds, tax-exempt bonds, FHA insured multi-family loans, including loans under the 223(f) and 221(d)(4) programs, Fannie Mae and Freddie Mac loan programs, and a variety of other private and governmental funding sources.
Matthew’s development experience includes drafting and negotiating purchase and sale agreements, complex easement agreements, declarations of restrictions, and community facilities agreements.
Additionally, Matthew forms Historically Underutilized Businesses (HUBs) and Community Housing Development Organizations (CHDOs) to be part of a development’s organization structure.
Matthew represents lenders and developers in the financing, acquisition and development of commercial real estate. He has extensive experience drafting and negotiating loan documents, reviewing due diligence materials including title and survey and leasing documentation, and handling all closing activities.
