Megan P. Caldwell is an environmental and energy attorney who delivers resourceful solutions and helps power the future. Megan leads environmental due diligence and permitting efforts for renewable energy projects across the country. She ensures the proper permits, approvals and studies are in place in areas such as air, water, waste, wildlife, transportation and aviation.

She also negotiates environmental and permitting provisions in financing agreements and works to manage her wind and solar clients’ environmental liability risks. The transactional part of Megan’s practice involves guiding clients through regulatory compliance issues they encounter in daily operations, such as environmental permitting, release reporting, internal compliance audits, inspections and enforcement actions.

She counsels clients on environmental issues that arise in real estate transactions, including analyzing site assessments and negotiating environmental contractual provisions.

Megan is also a litigator, representing companies in complex, multiparty environmental litigation and steering potentially responsible parties through the environmental cleanup of contaminated sites. Businesses look to Megan to defend them against California Proposition 65 notices and lawsuits, coordinate preventative audits and implement Proposition 65 warning label programs.

Megan’s technical background – an undergraduate degree in chemistry and research internships at Monterey Bay Aquarium Research Institute and NASA – allows her to weigh in on complex technical issues.

  • Provided environmental and permitting support to renewable energy developer that successfully obtained construction and tax equity financing for 238-megawatt Rio Bravo wind development project in Texas.
  • Coordinated environmental due diligence efforts for national self-storage client purchasing a $1.3 billion portfolio of 112 self-storage properties nationwide.
  • Achieved withdrawal of Proposition 65 notice of violation targeting manufacturer allegedly producing consumer products containing significant lead levels.
  • Assisted Fortune 500 company operating only elemental phosphorus production facility in the United States in updating its comprehensive Resource Conservation and Recovery Act (RCRA) strategy for operations and wastes.

Community Leadership : Megan represents Colorado nonprofit organizations on a pro bono basis, helping them with issues related to formation, dissolution, contracts and liability.
