Melissa Spievack focuses her practice on private client and family wealth planning matters, including estate planning, estate and trust administration, planning for retirement assets, charitable giving, and income, estate, generation-skipping transfer, and gift tax planning.
She has experience preparing a wide range of estate planning instruments, including wills, revocable “living” trusts, life insurance trusts, dynasty trusts, asset protection trusts, grantor retained annuity trusts, qualified personal residence trusts, charitable trusts, shareholders’ agreements, limited liability company and partnership agreements, prenuptial agreements, durable powers of attorney, and advance directives for health care.
Melissa has also counseled cross-border clients on pre-immigration planning, foreign and domestic trust issues (including fiduciary income taxation issues), and compliance with FATCA and CRS, as well as U.S. clients on planning for assets in foreign jurisdictions.
In addition, she has counseled clients on trust and estate litigation matters, including trust accountings, will contests, guardianship proceedings, and actions for construction and reformation of trusts and wills.
Melissa also counsels foreign and domestic tax-exempt organizations (including both private foundations and public charities) on formation, obtaining tax exempt status, state charitable registration, and ongoing corporate governance and tax compliance issues.
Prior to joining the firm, Melissa was associated with two large, international law firms in New York and a trusts and estates boutique firm in New Jersey.
