Molly Stine

Locke Lord LLP

Molly McGinnis Stine works with clients throughout the United States, England, Germany and elsewhere. She is part of the Firm’s Insurance: Litigation and Counseling practice group. She also is a member of the Steering Committee of the firm’s Privacy & Cybersecurity practice group, its Incident Response Team, and its New York Department of Financial Services initiative.

Clients engage Molly’s services for matters in litigation and mediation and for consideration of insurance policy wordings and potential exposures of existing or proposed insurance products. Her representation of insurers and reinsurers has involved cyber, technology, media, data security, professional liability, directors and officers, errors and omissions, and financial liability claims arising out of a number of different legal theories and factual situations.

She has dealt with third party liability and casualty claims including those involving catastrophic situations and those alleging bodily injury or property damage arising from long-time or latent environmental, occupational and other exposures. She also has addressed first party property damage and business interruption claims including hurricane, mining, cargo and trucking matters. In addition, her work has involved extracontractual and bad faith topics.

Molly has worked with matters relating to a wide variety of organizations and industries such as energy and oil, financial institutions, mining, chemical and other manufacturing, pharmaceuticals, telecommunications, public utility, medical devices, transportation, municipalities, real estate developers and others.

The matters in litigation have been of all sizes and in jurisdictions throughout the United States, although many have tended to encompass numerous parties and multiple claims. These actions often proceed simultaneously in competing or related actions in different states.

In handling these suits, Molly has conducted extensive document and testimonial discovery, worked with experts in a number of technical and other disciplines, and prepared and argued motions on key procedural, jurisdictional and substantive issues. Her experience includes jury and bench trials and matters on appeal.

Molly recognizes that not every matter should proceed to court or arbitration. She has regularly worked to resolve possible disputes without adversarial proceedings and to negotiate commercial settlements.

In particular, Molly’s practice focuses on the representation of insurers and reinsurers in respect of cyber, technology, media, data security, professional liability, directors and officers, errors and omissions, and financial liability policies and claims arising out of a number of different policy wordings, legal theories and factual situations.

The types of claims include first party and third party losses. She frequently works with, for example, claims concerning incident response, cybersecurity and privacy liability, regulatory proceedings, ransomware, malware, extortion, business email compromise, wire transfer fraud, business interruption or business income loss, data or system restoration or replacement costs, errors and omissions liability, and website or media content liability.

Molly also works with clients to create and implement programs and procedures for cybersecurity and privacy risk management, address regulatory and contractual requirements, to engage in solid practices for third party service provider and vendor relationships, and bolster incident preparedness and response readiness. Molly is a frequently requested speaker and a prolific writer on cybersecurity, privacy and insurance topics.
