Mónica M. Ortiz is a senior associate with significant experience in representing multinational entities in a broad range of complex contractual and business disputes. As a member of the Latin America Business Team, Mónica also focuses her practice on representing clients in internal investigative matters relating to due diligence and compliance, anti-corruption/bribery and high risk exposure events with a focus on Latin America.

Mónica has represented corporate entities in a wide array of disputes and investigative matters domestically as well as internationally. As a native Spanish speaker, Mónica is well positioned to represent clients doing business in Latin America and advising U.S. entities domestically with their operations interfacing with other Latino businesses and consumer markets.

Her experience includes representation of corporations against local government enforcement investigations relating to allegations of anti-competitive and unfair business practices. In Central and South America, Mónica has represented clients in connection with internal investigations under the Foreign Corrupt Practices Act (FCPA) and significant events requiring coordination with local government enforcement agencies.

Additionally, Mónica counsels clients on their use of Spanish company agreements, disclosures, policies and marketing materials. She is also proficient in Brazilian Portuguese. Mónica’s civil litigation experience is equally comprehensive. She has litigated actions in various state and federal courts in the United States, and as a result, is well adept to handle disputes in any jurisdiction at all stages of proceedings.

This includes handling interstate subpoenas for records and depositions, all forms of motion practice, including extensive experience with dispositive motions at the pleading stage and summary judgment, taking and defending depositions and drafting appellate briefs.

Mónica is particularly experienced with handling multifaceted disputes implicating contractual and jurisdictional choice of law conflicts. Mónica also has significant experience with large scale e-discovery projects as well as a particularized knowledge of forensic discovery.

Mónica has represented clients in the life sciences sector covering a variety of issues specifically impacting the pharmaceutical industry, including antitrust and competition, product manufacturers and distributors in disputes involving parallel foreign proceedings, financial institutions and retail industry clients defending consumer based class actions concerning privacy, marketing, advertising, and point-of-sale transactions.

As matters are often high-stakes in nature and implicate issues with a direct potential impact on her client’s business model and operating practices, Mónica’s advice transcends the practice of law and develops a tailored approach geared towards her client’s specific needs and objectives in order to effectively and efficiently achieve successful outcomes.
