Nicholas S. Goldin is a former federal prosecutor described by clients in Chambers USA as “incredibly insightful,” “highly responsive,” and “able to connect the dots probably better than any other attorney I’ve worked with,” Nick Goldin represents companies, boards, and executives in significant white collar criminal and regulatory matters, internal investigations, related civil litigation, and a range of other sensitive situations.

As Co-Chair of Simpson Thacher’s Privacy and Cybersecurity Practice, he advises companies on crisis response planning and cyber security incidents. Nick has handled government and internal investigations across the United States and in South America, Europe, and Asia for public and privately held companies, financial institutions, investment funds, and prominent non-profits.

Nick has defended clients in investigations and inquiries by the Department of Justice, the SEC, the CFTC, Congressional committees, and other federal and state criminal and regulatory agencies. The majority of his matters have never become public.

His clients have been in the financial services, private funds, industrial, retail, technology, health care, energy, aerospace and defense, hospitality and gaming, food services, and insurance sectors. These engagements sometimes involve coordinating simultaneous criminal and regulatory investigations, parallel civil litigation, whistleblower claims, and inquiries from outside auditors.

In addition, Nick has represented numerous executives as their personal counsel in grand jury and regulatory investigations and recently served as counsel to the DOJ and SEC-appointed global compliance monitor for Avon Products.

Nick’s matters have involved allegations relating to:

  • OFAC and other international trade sanctions

Nick also regularly counsels clients on compliance and corporate governance matters, including FCPA/anti-corruption, insider trading, responding to whistleblowers, and trade sanctions.

Nick is recognized in Chambers USA, where clients are quoted as saying that his “client service is impeccable” and he is “highly responsive, empathetic and able to provide very sound, objective guidance,” and is consistently recognized by The Legal 500 and Euromoney’s Benchmark Litigation. In 2018, Nick was named a “BTI Client Service All-Star” for “delivering the absolute best client service.”

Before joining Simpson Thacher, Nick served for six years in the Department of Justice as an Assistant United States Attorney in the U.S. Attorney’s Office for the Southern District of New York, where he was a member of the Securities and Commodities Fraud Task Force and the computer hacking group of the Major Crimes Unit.

As a federal prosecutor, Nick led parallel investigations with the Securities and Exchange Commission, the Commodity Futures Trading Commission, FBI, and other law enforcement and government agencies. He also conducted criminal jury trials and evidentiary hearings in federal district court and argued appeals in the U.S. Court of Appeals for the Second Circuit.

Nick graduated from Cornell Law School, where he was Editor-in-Chief of the Cornell Law Review, and from Cornell University, magna cum laude and with distinction in all subjects, where he was Assistant Managing Editor of The Cornell Daily Sun.

He taught a semester-long course on cybercrime as an adjunct professor at Fordham Law School and lectured at the Department of Justice’s national training center on cybercrime issues. Nick is one of the Firm’s Hiring Partners.
