Nicholas Stack

Nicholas T. Stack is an associate in the Litigation and Employee Compensation and Benefits groups, Nick has extensive experience consulting with clients and litigating a broad range of commercial, appellate, and Employment Retirement Income Security Act (ERISA) issues.

His commercial and appellate practice involves litigating and consulting on numerous business torts, contract disputes, trade secret claims, and non-competition and non-disclosure covenants. Nick’s ERISA practice includes litigating, arbitrating, and consulting on cases involving withdrawal liability, delinquent contributions, benefit interpleaders, and subrogation.

With his primary academic passions lying in history and government, Nick felt a predisposition to the legal profession. At Dartmouth College, he was particularly drawn to study the history, development, and application of the rules and structures that guide our local, national, and international interactions.

In law school, he developed and refined his legal advocacy skills and began his development into a civil litigator. While at Boston College Law School, Nick was the managing editor of the Boston College Environmental Affairs Law Review.

When not at work, having a variety of interests keeps Nick occupied. Besides spending time with his wife and three children, he enjoys playing competitive squash and softball and following his favorite Detroit sports teams. He also appreciates his time outdoors hiking and backpacking and has found himself in such faraway places as Isle Royale National Park and the White Mountains of New Hampshire.

Representative Matters:

• Trial: successfully prosecuted client’s multimillion dollar compensatory damage and punitive damage claims as second-chair trial attorney during six-day jury trial in Lucas County.
• Trial: successfully prosecuted client’s non-competition and trade secret misappropriation claims as second-chair trial attorney during three-day trial in Licking County.
• Appellate: successfully defended several clients against multimillion dollar claims in federal court and preserved the trial court’s judgment before the Sixth Circuit Court of Appeals. Bradley J. Delp Revocable Trust, et al. v. MSJMR Irrevocable Trust, et al., 665 F. App’x 514 (6th Circuit 2016).
• Appellate: successfully preserved judgment on client’s non-competition and trade secret misappropriation claims before the Sixth District Court of Appeals. Hinsch v. Root Learning, Inc., 2013-Ohio-3371 (Ohio Ct. App. 2013).
• ERISA: successfully prosecuted client’s withdrawal liability claim against withdrawing employers. Board of Trustees of the Ohio Carpenters’ Pension Fund v. Ramunno Builders, Inc., et al., 2016 WL 4729305 (N.D. Ohio 2016).
