    Little Integrity or Human Decency

    I was the plaintiff on an arbitration case against Comcast. DWT was represented by Pat Curran out of their DC office.

    I was forced to file a complaint when Comcast deleted my Internet account of 27 years without my request, knowledge or consent. The account contained 27 years worth of emails, contacts, receipts and more. The account email address had also been used to log into over 600 online accounts for me and my clients. In an instant, everything was gone.

    It took over 2 years of litigation before I learned that the account was deleted due to a software glitch. Comcast admitted, in writing, that they had made a mistake (without disclosing what the mistake was), but the law firm defended Comcast’s actions none the less. Their only defense was the exculpatory clause contained in all Comcast subscriber agreements. That clause basically states that even if one is somehow killed by using their services, Comcast is not liable. In other words, they aren’t liable for anything; including but not limited to the destruction of 27 years of information, being locked out of bank accounts and the like, or for anything that might go wrong with their services.

    In the course of our 2 year proceedings, Mr. Curran committed numerous violations of professional conduct, including but not limited to; 1) withholding information, 2) making numerous false statements, 3) filing a dispositive motion to vacate using false statements and the wrong applicable state law, 4) making repeated discovery requests that were not only overly burdensome, but irrelevant to the case 5) refusing to go to mediation, in violation of the scheduling order and 6) acting in a discourteous, disrespectful and uncivil manner.

    I won the case. After so doing, Mr. Curran called to ask if I would be willing to “settle” for 50% of the award in exchange for his not appealing the case to district court. It is unfortunate that the legal profession is represented by someone with so little integrity or human decency.
