Mr. Peter J. Carton concentrates his practice in the areas of real estate development, health care, and public finance. Regarding real estate development, he has represented such clients as JP Morgan Chase Bank, N.A., F. Hoffmann-La Roche, McDonald’s, Barnabas Health, UPS, Rhone Poulenc (Rhodia), Boston Market, and Claremont Properties in matters ranging from individual business and industrial uses to large-scale commercial, health care, office/flex space developments and redevelopments.
He also is part of the firm’s health care practice group providing services across the full health care spectrum from acquisition, joint venture, corporate management and other contracts to regulatory issues of Stark, False Claims Act, Anti Kickback, and HIPAA claims and issues of both a civil and criminal nature. He also has extensive experience involving Medicare and Medicaid matters, as well as licensing, billing responsibilities, 855As and CMS/OIG issues regarding fraud and abuse, reimbursement, compliance issues as well as audits and 990 filing requirements.
Mr. Carton also has extensive experience involving governmental entities. He served as a member of the governing body and as a former Mayor of the Township of Middletown (Monmouth County’s largest municipality) and as Township Attorney to that township for six years.
This representation covered general governmental matters of almost every nature, including public contract and the public buildings and land laws, OPRA as well as litigation involving zoning, land use (including Mt. Laurel and COAH), solid waste disposal, construction contracts, personal injury, workers compensation, bid disputes, and sanitary sewer conveyance and capacity issues.
In addition, Mr. Carton has served as the head of the firm’s Public Finance Practice since its inception in 1981. The firm regularly serves as bond or underwriters counsel to issuers or investment bankers in New Jersey, New York, Pennsylvania, and Delaware, including the State of New Jersey, New Jersey Health Care Facilities Financing Authority, Monmouth and Somerset Counties, Monmouth County Improvement Authority, and numerous county improvement authorities, municipal sewer and water and pollution control authorities, and school boards. Issues have ranged from competitive to negotiated; general obligation to revenue; and appropriation backed and refundings secured by insurance letters of credit or County guarantees.
