EXPERIENCE :

  • Representation of Class I railroad carrier in three appeals in the Eleventh Circuit. Resulted in favorable federal preemption opinions in each, including a published opinion on preemption subsequently cited by other federal courts of appeals.
  • Representation of software company in appeal of adverse order granting summary judgment (client was represented by another law firm in trial court). The appellate court agreed with our arguments, and reversed the trial court in a published opinion.
  • Representation of Cypriot energy company in shareholder derivative lawsuit seeking over 80 million dollars in damages. The suit was filed in Florida state court in conjunction with parallel actions in Cyprus and Switzerland. The trial court granted our motion to dismiss, finding that governing Cypriot law, unlike United States law, did not permit the “multiple” derivative suit filed by the plaintiff.
