Arlington business attorney R. Scott Caulkins has 30 years of experience in complex commercial and business litigation matters, outside general counsel matters, and franchise and distribution law in northern Virginia.
As a commercial law and business litigator, Mr. Caulkins represents companies and individuals in state and federal courts and arbitration proceedings throughout Virginia and the District of Columbia in a wide range of matters including breach of contract, business torts and intellectual property disputes.
As an established Northern Virginia attorney, Mr. Caulkins is frequently called upon to serve as local counsel to out-of-state and national law firms in cases in the United States District Court for the Eastern District of Virginia, often referred to as the “Rocket Docket” for the speed with which it disposes of motions and other matters before it according to local court rules and procedures.
Mr. Caulkins also represents businesses as outside general counsel on a variety of legal matters, including entity formation, purchasing and selling of businesses, preparation of customer contracts, resolution of disputes with vendors, commercial leasing and general employment matters.
Mr. Caulkins has included franchise law as a major part of his practice since 1985, representing both franchisorsand franchisees in a broad range of franchise law matters, including the preparation of franchise agreements and franchise disclosure documents, as well as franchise registrations.
He also counsels franchise companies on franchise compliance issues and has represented companies in connection with state investigations in Maryland and Virginia involving alleged violations of franchise disclosure laws. Mr. Caulkins has represented franchisors and franchisees in numerous lawsuits in state and federal courts involving alleged violations of their franchise agreements, franchise disclosure laws, and related claims.
Mr. Caulkins was selected to Virginia and Washington, D.C. Super Lawyers multiple times. He is a Fellow of the Litigation Counsel of America, an honorary society of trial lawyers comprised of less than .5% of lawyers in the United States.
He has spoken at numerous continuing legal education programs sponsored by local bar associations, the ABA, and the International Franchise Association on franchise law and litigation topics. Mr. Caulkins has also authored articles on franchise law topics that have appeared in local and national legal publications.
He authored a chapter in Covenants Against Competition in Franchise Agreements, Second Edition (2003), ABA Publishing, American Bar Association, and served on the Editorial Board of the Franchise Law Bibliography, Second Edition, a publication of the Forum on Franchising, Section of Antitrust Law, American Bar Association.
