Richard A. Schwartz

Richard Schwartz concentrates his practice on complex business litigation and arbitration, often involving technology companies, sophisticated investors, white collar criminal defense and contract disputes.

Both in private practice and as a trial attorney for the U.S. Department of Justice, Mr. Schwartz has successfully litigated complex claims including misappropriation of trade secrets, breach of contract, breach of fiduciary duties, fraud, First Amendment constitutional challenges and tax controversies. Mr. Schwartz has assisted in numerous matters, including:

• representing a wearable device designer and producer in asserting claims alleging misappropriation of trade secrets, among other claims;
• representing claimants in an arbitration involving claims of breaches of contract and breaches of fiduciary duties in managing a venture capital fund;
• drafting and filing numerous amicus curiae briefs with the U.S. Supreme Court, the California Supreme Court, the U.S. Court of Appeals for the Ninth Circuit and the U.S. Court of Appeals for the Fourth Circuit
• advising a technology company about its controversies with local taxing authorities;
• representing a game developer in its defense against a putative class action alleging claims of improper user tracking; and

Mr. Schwartz also has an extensive pro bono practice, which has included representation of clients advancing claims of constitutional rights violations, fraud and Fair Housing Act violations, as well as constitutional challenges to state policing practices.
