Richard M. Goldstein is a senior partner in Proskauer’s Litigation Department. After graduating from New York University School of Law, he served as a law clerk for the Chief Judge of the United States District Court for the Southern District of New York.
Since that time, Richard’s litigation experience has encompassed a wide array of complex and celebrated matters, including litigations and class actions in a variety of industries and practice areas.
For example, Richard has extensive experience litigating intellectual property disputes, including false advertising, commercial defamation, deceptive practices, unfair competition and related business torts, as well as patent and copyright matters. Clients he has recently represented in such matters include Church & Dwight Co., Inc. and The New York Yankees.
Richard is also a member of Proskauer’s well-known Sports Law Group. He has significant and varied experience in the area of sports business and law, having handled high-profile matters ranging from sports and sponsorship marketing to stadium safety to the application of the Americans with Disabilities Act to professional sports leagues and facilities.
Richard has been interviewed by the national media and has written and lectured on these topics. Among the clients he has represented in sports law matters are The New York Yankees, the National Hockey League, Texaco Inc., The Ladies Professional Golf Association and the ATP Tour.
Richard also has substantial experience in commercial real estate and construction related litigation, having represented such clients as Vornado Realty Trust, Credit Suisse and numerous other owners and developers.
These matters typically have involved extremely complicated commercial relationships as well as extensive real estate holdings. In this regard, Richard has been invited to lecture on the litigation aspects of complex real estate transactions, including issues relating to the formation of binding agreements and damage limitation clauses.
Richard is the principal litigator in the firm’s Lodging & Gaming Group. He has counseled numerous operators and owners regarding strategic alternatives and has represented them in litigation and arbitration proceedings. Companies he has represented have included Meridien Hotels, Inc., The Pivotal Group and Swissôtel Management (USA) L.L.C.
In the securities field, Richard has represented high-profile clients, such as one of the major national accounting firms, in securities litigation matters. For example, he established important precedent in the First Circuit in the successful dismissal of a securities fraud class action complaint. He also has represented clients in contested proxy litigation and related shareholder suits.
A “lawyer’s lawyer,” Richard’s practice has included representing attorneys in law firm dissolution cases. While most such matters have been settled favorably, Richard also has successfully tried such cases to judgment in his clients’ favor.
