Richard P. Dyer

Richard Dyer practices in the area of construction law, including both contentious and non-contentious matters. Mr. Dyer has extensive experience in a broad range of construction, transactional and dispute resolution matters, including: preparation and negotiation of construction contracts, turnkey/design-build contracts, EPC contracts, construction management contracts, architect and engineer agreements, consultant agreements and trade contracts/subcontracts; contract administration; EEO and OSHA matters; surety bonding, mechanic’s lien and insurance matters.

He advises on the resolution of construction, engineering, and other commercial disputes through litigation, arbitration, including AAA and ICC administered proceedings, and mediation. Representative projects include: stadiums, aquariums, waste-to-energy facilities, power projects, LNG/LPG facilities, paper mills, casino resorts, infrastructure/transportation facilities, telecom loops, hospitals, institutional buildings, research facilities, schools, manufacturing facilities, assisted living facilities, museums, hotels and high-rise commercial and residential buildings.

Mr. Dyer has advised and represented owner/developers, contractors, and subcontractors on matters involving the total construction process from the pre-construction phase through the construction phase and beyond involving matters such as contract formulation, claims, dispute avoidance and resolution, suretyship, liens, insolvency, default, and termination.

• Providing transactional advice to a state power authority concerning tender documents and contracting forms for supply, construction and turnkey projects.
• Drafting and negotiation of FIDIC-based design-build contract documents for a 1,400-unit military housing project near Seoul, South Korea.
• Representation of an international NGO on a multibillion-dollar capital program to perform a complete rehabilitation of its headquarters campus in New York City.
• Providing transactional services to the planning and construction office of a world-renowned research and teaching university in the biomedical sciences in connection with its capital construction program at its campus in New York City.
• Review of FIDIC-based contract documents for a shopping center and entertainment complex in Riga, Latvia.
• Representation of an international contractor on a South American hydroelectric project involving miles of tunnels by TBMs and conventional methods.
• Representation of a design/build contractor in litigation with a subcontractor on a Waste to Energy Plant in Federal District Court in Boston, Massachusetts.
• Representation of a general contractor in a state court action against a public transportation authority seeking to recover delay damages for itself and a subcontractor under a liquidation agreement.
• Representation of an institutional museum owner in the prosecution of fire damage claims against insurance carriers and in the defense of delay damage claims by a trade contractor.
