Robert E. Zimet

Robert Zimet successfully leads litigation efforts on behalf of clients involved in high-stakes commercial, corporate and securities disputes. Mr. Zimet appears on behalf of clients and has tried matters and argued appeals in federal and state courts throughout the country. He actively represents clients in SEC investigations.

In the appellate realm, he has argued cases in eight of the federal circuits, in the highest courts of several states and numerous times in intermediate appellate courts. The appellate victories he has secured for his clients have included precedent-setting disputes typically arising in the context of complex financial transactions embracing securities, tax, bankruptcy and corporate law issues.

Recent appellate successes include matters for American Express Company (in which the Second Circuit delineated the parameters of the PSLRA’s safe harbor provisions), directors of Fremont General Corporation and Paul Allen (in which the Second Circuit affirmed the applicability of the bankruptcy doctrine of “equitable mootness” despite contrary decisions from five other federal circuits).
