Samuel Stubbs

Samuel E. Stubbs maintains a practice focused on complex litigation, with an emphasis on commercial disputes, class actions, intellectual property (patents), environmental and bankruptcy. He is experienced in matters relating to extra-contractual liability, corporate environmental liabilities and international sovereign immunity.

Sam has served as lead trial counsel in cases involving commercial fraud, business torts, alleged kickbacks, intellectual property, adversary proceedings in bankruptcy, class action litigation, Superfund liability and multinational mass tort.

Sam has represented major oil and gas and chemical companies in a variety of international commercial disputes, technology companies in patent litigation, and financial institutions in commodity, lender liability and indentured trustee litigation.

For 40 years, Sam has balanced a complex commercial practice (both plaintiff and defendant) with a class-action mass tort defense practice. Thus, he has remained a true “hired gun,” handling litigation involving contract disputes, patent litigation bankruptcy (adversary proceedings), construction, chemical and petrochemical environmental claims, real estate, arson, fidelity bonds, oil and gas, securities, shareholders derivative actions, union lockouts, tortious interference, defamation, fraud, RICO, grand jury investigations, alleged oilfield kickbacks, and Superfund cleanups.

REPRESENTATIVE EXPERIENCE :

• Currently representing a private fiber optics, cable, and internet provider (the oldest in Texas) in an intergeneration litigation over division of the assets.
• Representing an international mining and metals producing company in a dispute involving environmental issues related to a 165-mile stretch of the Upper Columbia River in Washington State.
• Representing a number of both foreign and domestic high tech companies in patent litigation involving hand held video devices, cell phone handsets, camera phones, oil field equipment, and computer hardware and software.
• Argued successfully at the Fifth Circuit Court of Appeals for a German software manufacturer a licensing dispute originally brought in U.S. Federal District Court in Texas.
• Represented lenders in New York and Minnesota in matters involving disbursement of funds under indentured trust agreements.
• Resolved by settlement decade old litigation for a major oil producer involving claims of damage to groundwater under parts of a Texas city.
• Since 1997, representing a publicly traded oil refiner in various mass suits brought by neighbors, environmental groups, union members (the leadership of which conducted a four year “corporate campaign”) and shareholders.
