Sanya Sukduang

Sanya Sukduang has a dynamic practice litigating matters concerning Abbreviated New Drug Applications (ANDA) challenges for brand drug manufacturers, diagnostic methods, biological products and medical devices. He has been the recipient of various awards and nominations, including repeatedly recognized by LMG Life Sciences as an Intellectual Property: Life Sciences Star.

He was also shortlisted for “General Patent Litigator of the Year-DC,” at the 2016 and 2017 LMG Life Sciences Awards and for “Outstanding Litigator-District of Columbia” at the 2017 Managing Intellectual Property North America Awards.

Sanya concentrates on patent litigation before federal district courts and the U.S. Court of Appeals for the Federal Circuit, and post-grant proceedings before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO), primarily in the areas of biotechnology, pharmaceuticals, biologics, diagnostics, and medical devices.

He has conducted all aspects of pre-trial, trial, post-trial, and inter partes review (IPR) proceedings before the PTAB. Drawing from extensive experience in cases arising from ANDA filings, Sanya advises clients on an array of issues concerning biologics, including due diligence investigations and strategic patent portfolio planning.

He frequently lectures in the United States and abroad on topics such as Hatch-Waxman litigation and biologics and biosimilars issues arising under the Biologics Price Competition and Innovation Act (BPCIA). He has also authored numerous articles on these topics.

As a former chair of Finnegan’s Diversity and Inclusion Committee, Sanya is committed to strengthening diversity both within the firm and throughout the legal profession and was ranked as Best Lawyers Under 40 by the National Asian Pacific American Bar Association.

He served as adjunct professor of patent law at Howard University Law School, and he currently serves as adjunct professor of Hatch-Waxman litigation at the Washington College of Law.

In his pro bono practice, Sanya served as lead trial and appellate counsel in an adoption proceeding, successfully assisting a foster mother’s efforts to adopt her three-year-old foster daughter.
