Ms. Tanya Moskalenko is counsel in the Employee Benefits & Executive Compensation Department of the Los Angeles Century City office of Seyfarth Shaw LLP. She has advised and represented clients in all aspects of employee benefits law since 1996. Ms. Moskalenko’s practice focuses on compliance and administration of pension and welfare plans.
She has experience with a variety of issues relating to these types of plans, including plan design and drafting, participant communications, mergers, benefit claims and procedures, QDROs, domestic partner coverage, reporting requirements, fiduciary liability, and other federal and state related compliance requirements.
Ms. Moskalenko also assists plan sponsors with retirement plan tax qualification requirements, and has represented plans before the IRS in connection with qualification and reporting issues. Ms. Moskalenko has extensive experience with multiemployer retirement and health plans providing advice on all areas of benefits, including fiduciary responsibility, benefit claims, prohibited transactions, and compliance issues.
As part of her multiemployer plan experience, Ms. Moskalenko has worked with trustees of multiemployer plans and employers on general and complex withdrawal liability issues, including partial and complete withdrawal liability triggers, calculations, and abatement matters.
She has also represented a major pension plan through insolvency proceedings with the Pension Benefit Guaranty Corporation (PBGC), and has worked directly with the PBGC on alternative withdrawal liability agreement and guaranteed benefits issues.
Ms. Moskalenko regularly attends multiemployer plan board and subcommittee meetings. Ms. Moskalenko represents a wide variety of clients from small employers with single employer plans to large entertainment industry multiemployer retirement and health plans.
