
Formerly a Kirkland partner, Terri Abruzzo returned to the firm as Of Counsel to resume her successful and wide ranging commercial litigation practice. Terri has extensive experience in preparing and trying cases before federal courts, state courts and administrative agencies and a cost-effective, client-centered approach.
Terri has experience in all phases of litigation, including investigation, witness preparation, motion practice, deposition and trial work. She focuses on products liability, class actions, antitrust, breach of contract, copyright infringement, environmental tort, employment, insurance coverage, unfair competition, business torts and general complex commercial litigation.
Counsel for GM in multidistrict litigation and related matters arising out of various recalls conducted by General Motors LLC.
EMF/Cellular Phone Litigation/Kane v. Motorola. Counsel for Motorola and Ameritech in cases where plaintiffs claimed their cell phones caused brain cancer. Drafted numerous winning briefs, argued motions, took depositions, including plaintiff’s doctors, worked with expert witnesses, prepared Daubert and trial defense outline. To date, no cases have survived a motion to dismiss or a Daubertmotion.
Hearing Loss Cases. Counsel for General Motors Electro-Motive division in a series of cases brought by plaintiff engineers and firemen who claimed hearing loss due to excessive noise in vehicle cabs. Successful in getting all cases dismissed.
In Re Pantopaque Litigation. Counsel for Alcon Laboratories in cases where plaintiffs claimed that use of the Pantopaque contrast medium caused their arachnoiditis.
State of Alaska v. Tesoro Alaska Petroleum Co. (Dist Ct. Alaska) First chair trial counsel in defense of Section 1 and Section 2 class action brought by Alaska Attorney General, parens patriae, against client for monopolization/attempted monopolization of the propane market. After depositions and other discovery, defeated class certification, resulting in nominal settlement for client.
State of Alaska v. Suburban, Tesoro (9th Circuit) Appellate counsel for Tesoro when District Court’s denial of intervenor’s motion appealed to 9th Circuit. Denial of intervention upheld on appeal.
Kahn v. Motorola (EDNY) Counsel for Motorola in this antitrust/patent misuse/RICO case. Conducted all pretrial discovery and expert work and drafted winning summary judgment motion on the patent misuse and RICO claims.
