Thomas J. Madigan is a construction lawyer with more than 30 years of experience and leads the firm’s Construction Practice Group. Tom represents owners, general contractors, construction managers, engineers and manufacturers and suppliers of systems, products and materials utilized in construction.
He is experienced in all aspects of construction law from the negotiation of contracts to project counseling and the prosecution and defense of claims. He has extensive knowledge of all types of project delivery systems, including traditional design-bid-build, design-build, EPC, DBOM, and public-private partnerships.
Tom has litigated construction and design defect claims, delay and disruption claims and payment claims arising from public and private projects in jurisdictions across the United States. His extensive litigation experience includes numerous jury and bench trials, arbitration cases and appeals before the Pennsylvania Supreme, Superior and Commonwealth Courts and the United States Court of Appeals for the Third Circuit.
Tom’s experience as a litigator informs his advice and counsel at the front-end of a project, as he knows what can go wrong when the parties do not anticipate and properly allocate the risks of performance. When called on during a project in trouble, Tom looks for practical and efficient solutions, while also making sure the client is properly positioned should litigation prove unavoidable.
When his clients find themselves caught up in litigation, Tom believes that there is no substitute for an in-depth understanding of the facts of the case and the governing law. Clients who have gone through litigation with Tom comment on his grasp of the design and construction details, and his ability to recall underlying events and facts and recite them in presentation to the mediator, or in arguments to the arbitrator or judge, or when cross-examining opposing fact and expert witnesses.
