Thomas Barba represents clients in complex litigation and regulatory matters nationally. He has helped clients defend class, regulatory, and individual claims involving many technologies and products. As national trial and coordinating counsel, Tom has managed multidisciplinary teams of lawyers and local counsel in all 50 states to handle mass tort, regulatory enforcement proceedings, and product liability litigation.
He helped form and manage the firm’s Complex Litigation & Discovery Center, which is equipped with the staff, technology, and capacity to handle the most significant and document intensive cases.
Clients value Tom’s ability to get to a solution. That can be through litigation, but Tom’s most successful matters have been resolved through factual and legal analysis and then settlement advocacy. In recent years, he has helped clients resolve disputes involving large-scale natural resources development, wind power, and many cases involving consumer products.
In recent years, he has helped resolve several large class actions. Tom is said to have a particular talent for resolving cases where the root cause of a product defect is elusive. In more than two decades of litigation and settlement advocacy, he has resolved scores of such cases.
Tom started the firm’s Consumer Product Safety Commission practice and has first-chaired client responses to CPSC demands for corrective action and recalls for several decades. He provides advice and counsel to companies faced with challenging decisions on how and when to self-report an alleged product defect.
Tom’s decade of work at the US Department of Justice earlier in his career, gives him strong insights into how the government views these cases. For more than a decade, Tom served as Steptoe’s general counsel. That experience has led him to work advising and defending law firms and members of the bar in matters involving allegations of professional liability.
