Mr. Fulmer counsels clients on a broad range of business law and federal, state and local taxation issues. He places an emphasis on comprehensive planning for businesses and business owners. Much of Mr. Fulmer’s time is spent representing clients in transactions involving the sale or acquisition of businesses.
Mr. Fulmer’s practice ranges from counseling clients regarding tax consequences flowing from selecting to organize a new business as a corporation, limited liability company, partnership or other type of entity to assisting clients with structuring the sale of existing businesses in tax beneficial ways. With an emphasis on business owners, he also assists clients and their financial advisors with an array of estate tax planning matters. Mr. Fulmer also has extensive experience representing clients in controversies with the Internal Revenue Service, as well as state and local taxing authorities.
Mr. Fulmer previously practiced as a Certified Public Accountant with a national CPA firm for several years. Further, his legal education was focused on business law and taxation. In addition to his Juris Doctorate degree, he received an LL.M. in Taxation (with Honors) from the University of Alabama School of Law. The experience he gained as a CPA, coupled with his education, have provided the basis for his current practice.
As his clients have grown their business, Mr. Fulmer has expanded his practice to represent them in matters involving a broad range of federal and state regulatory agencies, including the Food and Drug Administration (FDA), Federal Trade Commission (FTC), state Departments of Insurance and others. Mr. Fulmer has successfully represented clients in very complex civil litigation versus the FDA and the FTC involving dietary supplements, direct marketing, and other industries. He represents major manufacturers and marketers of vitamins, herbs, food supplements and generic drugs. Mr. Fulmer has extensive experience in the review of advertising and marketing materials, as well as the representation of companies in investigations initiated by the FTC, FDA, and various State Attorneys General. Mr. Fulmer has extensive experience with representing clients in complex adversarial proceeding relating to the scope of various Federal and state agencies powers to regulate. Mr. Fulmer has also successfully handled negotiations of consent decrees and other resolutions which have allowed clients’ operations to successfully continue operation after significant Federal or state agency intervention.
Mr. Fulmer also advises clients on all aspects of trademark law, including prosecution, litigation, licensing, and clients’ ability to protect trademarks and service marks. He has guided many companies with respect to clearing, registering, protecting and licensing their creative properties in the United States, and litigated a number of complex intellectual property matters.
