
Troy Bataille represents individuals, businesses, and insurers in matters involving professional liability, environmental compliance, insurance coverage, and a variety of forms of civil litigation. His work in these areas has gained him substantial courtroom experience as well as proficiency in cases involving an array of critical legal and professional disciplines. Troy draws from this well-rounded experience to provide clients with both preventative counsel and representation in litigation or following a governmental investigation.
Troy focuses his professional liability practice on the defense of lawyers in negligence, breach of fiduciary duty, breach of contract, vexatious litigation, and similar claims commonly brought against lawyers.
He also represents real estate agents and brokers in claims involving alleged errors and omissions; psychologists in matters involving claims of malpractice and misdiagnosis; and long-term care facilities and nursing homes and their staff in professional malpractice and health care-related actions.
His environmental experience includes counseling manufacturers, chemical companies, cleaning and fueling companies, higher education institutions, and municipalities on state and federal regulatory compliance regarding an extensive range of environmental media and regulations.
He regularly counsels clients through preemptive solutions for compliance with current and changing laws and after government inspections or enforcement actions, as well as the environmental aspects of commercial real estate transactions, and he has handled environmental litigation.
Troy is a part of an innovative team of lawyers and engineers that work with over 300 colleges and universities, including many top-tier institutions, in the successful development of a self-audit and disclosure program under the Environmental Protection Agency’s Audit Policy. That program has saved his clients millions in potential fines and established a benchmark for future audits of all EPA-regulated industries. Troy frequently presents to industry and trade groups on environmental compliance regulations and related topics.
Troy provides insurance coverage analysis; defends insurers in contractual and extra-contractual litigation, including bad faith; and defends clients under commercial general liability (CGL) policies. He is a frequent contributor to Goldberg Segalla’s Casewatch: Insurance and Environmental Coverage Quarterly newsletters and its Insurance and Reinsurance Report blog.
His extensive general litigation experience includes matters involving transportation and trucking, auto accidents, premises liability, commercial negligence, contract disputes, workers’ compensation and ERISA/Medicare liens, construction law, and product liability. He has also contributed significant pro bono work in probate court.
Troy was under the age of 30 when he received the 40 Under Forty award from the Hartford Business Journal and was the second-youngest to receive the honor that year. During law school, he was a law clerk for major international consumer-products corporation and clerked for the Majority Chief Counsel for the Connecticut House of Representatives.
He also represented indigent clients for New Haven Legal Aid in the Housing Division of the New Haven Superior Court.
