This is what happens when an innocent victim needlessly falls prey to an attacker. These are the type of people and families that I listen to, fight for, and to whom I have devoted my entire professional career.

Some lawyers spend years of schooling and even years into their career to decide what area of the law truly inspires them. This was not the case for me. I knew very early on that I was built to fight for and help people and families struck by tragedy and injury.

Even before taking my Oath of Attorney in 1995, I had the honor of training with some of the best personal injury lawyers in the entire country. Since that time, I have continued employing my skills with one clear mission in mind: whether by trial or negotiation, get justice for deserving people and their families when they have been hurt or suffered a loss.

Recently, my partner, Evan Lubell, and I went toe to toe with one of the largest corporations in the world, Walmart. In the end, it was clear that we were fair but they were not. When Walmart refused to offer a fair settlement to a client who suffered neck and back injuries in one of its stores, we refused their insultingly low offers. We knew in our hearts that our client deserved more and presented the case to a Lee County jury. The result was the largest slip and fall verdict ever rendered in the county.

Walmart insisted throughout the case that they had a multitude of rules in place to prevent slip and falls in its stores. We conceded and commended the retail giant for having these rules in place, but proved to the jury that it was Walmart’s needless failure to follow its own rules that directly led to the permanent and disabling injuries that our client will have to endure for the rest of her life.

While no one will ever be able to give this client her health back, as a result of the jury award, at least she won’t have to worry about how she will pay her medical bills and help put food on her family’s table. Additionally, we hope that Walmart is a safer place as a result of teaching them that the only thing more important than having lots of rules, is actually following them.

Ty is a member of the Florida Bar since 1995 and, also, is a member of the Trial Lawyers Section of the Bar. He is admitted to practice in the Supreme Court of the United States of America, all State Courts of Florida, and in the Federal Courts of Florida’s Middle District.

Ty is a member of various professional associations including the Florida Justice Association as an Eagle Member, the Southwest Florida Justice Association, the Lee County Bar Association, the American Board of Trial Advocates, and the Calusa Chapter of the American Inns of Court. Ty was recently the Chairman of the Florida Bar Grievance Committee of the 20th Judicial Circuit, Group D. He is very active and supportive of many local community organizations and schools.
