Viktoriya M. Shpigelman has experience with civil litigation and appellate matters, including commercial contracts, various financial matters, claims arising from breach of contract, fraud, and related business torts, and disputes concerning property damage resulting from commercial real estate construction.

She represents clients across the country in state and federal court and has significant experience advising some of the nation’s largest special servicers of commercial mortgage-backed securities (CMBS) assets on all aspects of commercial real estate loan litigation.

Viktoriya has particular experience working on appellate briefs to the U.S. Court of Appeals for the Fourth Circuit, the U.S. Court of Appeals for the Second Circuit, the Maryland Court of Special Appeals, and the Maryland Court of Appeals. She also has worked on opposing a petition for a writ of certiorari to the U.S. Supreme Court.

As an experienced litigator, Viktoriya is familiar with all stages of federal and state litigation, including drafting and responding to complaints, discovery requests, motions, and briefs; managing the discovery of electronically stored information; conducting in-depth factual and legal research and analysis; and taking depositions of fact witnesses and 30(b)(6) deponents.

Viktoriya also lends her legal counsel to those in need as a volunteer for the House of Ruth, representing victims of domestic violence pro bono at protective order hearings, and through HIAS, the oldest voluntary resettlement agency in the world and one of the biggest in the United States.

In addition to her litigation skills, Viktoriya is also fluent in Russian. She routinely lends her knowledge of the Russian language to review contracts drafted in Russian, help in communicating with Russian speaking clients, and review Russian documents produced in litigation. Viktoriya has also acted as an interpreter for a witness in the inquiry into the death of Alexander Litvinenko.

Experience :

  • Part of an appellate litigation team that represented the majority owners of the Atlanta Hawks and Thrashers and Philips Arena in a $170 million high-profile fight against a minority owner over control of the teams and arena.
  • Part of an appellate litigation team that successfully advocated to the Maryland Court of Appeals for an amendment to the Court’s decision regarding the inherently dangerous nature of pit bull mixes and cross-bred pit bull mixes.
  • Helped secure summary judgment in federal court in favor of a commercial mortgage lender against the property’s manager and borrowers’ consultant for diversion of rents generated by the property.
  • Assisted in winning an early dismissal of tort and contract claims brought by a former employee against a major university and helped to successfully oppose an appeal of the dismissal in the U.S. Court of Appeals for the Fourth Circuit and successfully oppose a petition for a writ of certiorari to the U.S. Supreme Court.
  • Part of a team that successfully represented a commercial property owner in a multi-million-dollar dispute concerning property damage resulting from the construction of a neighboring 17-story apartment complex, including the award of attorneys’ fees that was confirmed on appeal to the Maryland Court of Special Appeals.
