K. Winn Allen is a litigation partner in Kirkland & Ellis LLP’s Washington, D.C. office. He litigates complex commercial cases in federal and state courts across the country. Winn has handled cases on a broad array of subject matters, including antitrust, contracts, class actions, fraud, labor and employment, mass torts, mergers and acquisitions, products liability, securities, and unfair trade practices.
Representative clients include BASF, Bain Capital, Caterpillar, Facebook, Honeywell, the State of Georgia, and Wyndham Hotels & Resorts. He has resolved cases with motions practice, represented clients at numerous trials and preliminary injunction hearings, and argued multiple cases before the federal courts of appeals.
Before joining Kirkland, Winn served as a law clerk to Justice Samuel A. Alito, Jr. of the Supreme Court of the United States and Judge Jeffrey S. Sutton of the United States Court of Appeals for the Sixth Circuit.
Complex Litigation & Class Actions:
- INEOS v. BASF — Defeated preliminary injunction and won voluntary dismissal of lawsuit brought by INEOS seeking to enjoin the sale of BASF’s polyolefin catalysts business to W.R. Grace.
- Luca v. Wyndham — Counsel for Wyndham in putative nationwide class action challenging hotel billing practices.
- Windy City Investments v. TIAA — Counsel for a Madison Dearborn Partners’ portfolio company in litigation against TIAA stemming from the 2014 sale of Nuveen Investments, Inc.
- Florida v. Georgia — Counsel for the State of Georgia in a rare “original jurisdiction” dispute with Florida pending in the Supreme Court of the United States. The case is being litigated before a Special Master appointed by the Court to conduct discovery and trial proceedings.
Disputes With Government:
- FTC v. Wyndham — Counsel for Wyndham in lawsuit brought by the FTC alleging that Wyndham’s data-security practices constituted “unfair” and “deceptive” trade practices under Section 5 of the FTC Act.
Appellate Matters:
- Watkins v. Honeywell — Lead appellate counsel for Honeywell in case concerning alleged breaches of collective bargaining agreements. Obtained unanimous victory before the Sixth Circuit.
- Sikhs for Justice v. Facebook — Lead appellate counsel for Facebook in lawsuit alleging violations of Title II of the Civil Rights Act. Case resulted in the Ninth Circuit affirming the dismissal of all claims against Facebook.
