Eric Choi concentrates his practice in complex patent cases for clients in the pharmaceutical and biotechnology industries. Eric is a registered patent attorney and focuses his practice on the representation of generic pharmaceutical companies in Hatch-Waxman litigation.
Eric is also experienced in the drafting and prosecution of patents in the pharmaceutical and medical device industries. Prior to attending law school, Eric was a chemist at Merck & Co., Inc. where he researched crystalline organic molecules and was part of multiple development teams as the lead investigator for polymorph and salt selection of drug candidates from pre-clinical to Phase III clinical trials.
Eric is also a co-inventor of U.S. Patent No. 8,513,234 entitled HIV Integrase Inhibitors and U.S. Patent Application Publication No. 2014/0206605 titled Crystal Forms of HIV Integrase Inhibitors.
Eric earned his J.D. from Chicago-Kent College of Law and received his B.S. in biochemistry from Northern Illinois University. Prior to attending Northern Illinois University Eric was in the Integrated Science Program at Northwestern University.
EXPERIENCE :
- Represented Endo Pharmaceuticals Inc. and Strakan International S.à r.l. against Watson Labs’ attempt to make a generic version of Endo’s FORTESTA® product. Following a bench trial, the judge ruled in our clients’ favor on all contested issues and rejected the defendant’s claims of non-infringement, invalidity, and unenforceability. Successfully argued on appeal with the Federal Circuit affirming the trial court decision.
- Represented Apotex Inc. and Apotex Corp. in a patent infringement action regarding Apotex’s biosimilar applications to make biosimilar versions of Amgen’s NEULASTA® and NEUPOGEN® products. We navigated Apotex through the Biologics Price Competition and Innovation Act’s “patent dance,” and in the first BPCIA case to go to trial, we obtained a verdict of noninfringement. This result was affirmed on appeal to the U.S. Court of Appeals for the Federal Circuit.
