Lucia Nale

Lucia Nale is a litigation partner in our Chicago office, focusing on general civil litigation, with a particular emphasis on the defense of financial institutions in the consumer financial services industry. Lucia is a member of Mayer Brown’s Partnership Board and heads the firm’s Consumer Class Action practice.

She frequently provides compliance advice and litigation risk analysis to industry clients. She represents a number of prominent financial institutions, including national banks, federal savings banks, state-chartered banks, mortgage lenders, investment advisors and automobile finance companies, and serves as national consumer class action defense counsel for particular clients.

Over the years, Lucia and others in the practice have successfully defended more than 100 individual and/or class action suits arising under the Truth in Lending Act (TILA), Fair Credit Reporting Act (FCRA), Fair and Accurate Credit Transactions Act (FACTA) Equal Credit Opportunity Act (ECOA), Fair Debt Collection Practices Act (FDCPA), Real Estate Settlement Procedures Act (RESPA), Electronic Fund Transfers Act (EFTA), Telephone Consumer Protection Act (TCPA) and various state and federal unfair and deceptive trade practices statutes (UDAP).

The matters at issue in these cases include fair lending and ECOA; compliance with FCRA and FACTA, including credit prescreening and adverse action notice requirements; privacy; TILA disclosures; the legality under RESPA of a variety of business practices; federal preemption; arbitration; assignee and loan servicing liability; foreclosure, bankruptcy and default related issues; and claims challenging the legality of various consumer lending and credit practices under a variety of federal and state laws, including UDAP laws. Lucia joined Mayer Brown in 1989 and became a partner of the firm in 1998.
