Andrea Christensen practices in the areas of intellectual property, trademark, copyright, entertainment and advertising law. Ms. Christensen negotiates trademark and copyright licenses and assignments, marketing services agreements, television agreements, software agreements, co-existence agreements and purchase agreements.
She counsels clients from the consumer products, technology, food, fashion and building materials industries on trademark clearance, maintenance and prosecution. Ms. Christensen has litigated trademark, copyright, domain name, unfair competition, trade dress, dilution and false advertising cases.
Prior to joining the firm, Ms. Christensen worked as a trademark legal intern at the United States Patent & Trademark Office. Ms. Christensen is a 2012 cum laude graduate of the University of New Hampshire School of Law, where she was articles editor for IDEA: The Intellectual Property Law Review, and a graduate, with comprehensive honors, of the University of Wisconsin–Madison.
Representative Matters:
- Obtained from the Trademark Trial and Appeal Board a reversal of a registration refusal for the BENEDIKTINER WEISSBIER trademark for beer products. The Board held that a disclaimer is not needed because the trademarked words are not “merely descriptive” in nature
- Obtained reversals of registration refusals for the BLOODY BUTCHER, GLOSS MODERNE, DRAKE X2, TRUEVUE, VCT QUALITY, FIT, COMFORT & AFFORDABILITY and Design trademarks based on the grounds that there was no likelihood of confusion between the aforementioned marks with registrants’ cited trademarks
- Obtained reversal of a registration refusal for the HOME CTO trademark based on the grounds that the CTO acronym was not merely descriptive of the applicant’s services
- Drafted trademark co-existence and consent agreements
- Negotiated marketing services agreements on behalf of a large New York City based real estate developer
- Represented global bag closure product company in a case involving claims for federal trade dress infringement, federal unfair competition, federal dilution and related claims under New York law; Obtained partial summary judgment on behalf of client
- Represented national beauty school, global bank, national nursing home and mattress companies in cases involving claims for federal trademark infringement, federal unfair competition and related claims under New York, Illinois and California state and common law; Obtained favorable settlements
- Represented global consumer products company in several cases involving claims for federal trademark infringement, federal unfair competition, federal trademark dilution, federal trade dress infringement and copyright infringement
