Darth Newman is a skilled trial attorney with a decade of litigation experience in complex commercial and intellectual property cases. His practice focuses on contract and shareholder disputes, computer hacking and data breaches, and trade secret misappropriation. Darth has conducted “bet the company” litigation and has tried shareholder disputes, fraud, insider dealing, and fiduciary duty matters worth millions of dollars.
Darth’s trial experience includes a federal jury trial, a Delaware Chancery Court trial, other state court trials and arbitrations. He has briefed several appeals in federal and state court, argued an appeal before the New Jersey Appellate Division, and briefed and argued various motions in federal and state court.
He helped secure an en banc Federal Circuit decision striking down a portion of the Lanham Act as unconstitutional; that decision was later unanimously affirmed by the United States Supreme Court. Examples of written decisions he has obtained appear below. Darth is also a skilled negotiator with a track record of resolving otherwise intractable disputes short of trial.
He is admitted to practice before the Third Circuit, Sixth Circuit, Federal Circuit, Eastern District of Pennsylvania, Western District of Pennsylvania and the District of New Jersey federal courts, and is a member of the Pennsylvania and New Jersey bars. His admission to the New York bar is pending.
Darth has also appeared pro hac vice in courts from California to Florida. An active member of his County Bar Association, Darth is the Vice Chair of the Professional Ethics Committee and belongs to the Federal Court Section.
Before joining Pollock Cohen, Darth gained experience at national and regional firms and a litigation boutique.
Darth earned a B.A. in Economics & Political Science with distinction from the University of Michigan in 2004. In 2008, he received his J.D. from the University of Pennsylvania Law School, where he served as an Arthur Littleton and H. Clayton Louderback Legal Writing Instructor, Senior Editor of the Journal of Business and Employment Law, and Associate Editor of the Journal of Labor and Employment Law.
An accomplished and active soccer referee and referee coach/mentor, Darth has officiated around the country. He has taken charge of professional matches and now serves as a State Youth Referee Administrator, the Vice President of his State Referee Committee, and a member of his Youth Soccer Board of Directors.
