John P. Phillips is an associate in the Labor & Employment Department in the Houston office of Seyfarth Shaw LLP. He is Board Certified in Labor & Employment Law by the Texas Board of Legal Specialization. Mr. Phillips’ practice focuses on labor and employment matters, including litigation in federal and state courts, and before administrative agencies. Mr. Phillips has expertise in defending employers in wage and hour class and collective actions.
He regularly defends management in employment claims under various state and federal statutes, including Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family Medical Leave Act, and the Texas Commission on Human Rights Act. Mr. Phillips’ experience litigating Title VII matters includes complex discrimination “pattern and practice” and class action cases.
Mr. Phillips also has experience defending management facing investigations by government agencies, such as the Department of Labor (“DOL”), the Occupational Safety and Health Administration (“OSHA”), and the Equal Employment Opportunity Commission (“EEOC”) against wage and hour, employee leave, workplace safety, discrimination, harassment, disability, and retaliation charges.
In addition, Mr. Phillips assists with management-side labor issues, including union grievances, collective bargaining negotiations, and unfair labor practices charges before the National Labor Relations Board (“NLRB”).
He also provides employment counseling and training to managers, supervisors, and human resources professionals relating handbooks and policies, internal complaints and investigations, FMLA and ADA accommodation and leave, and other employee relations issues. Mr. Phillips is an Honors graduate of the University of Texas School of Law, and received a Bachelor of Arts in History from Michigan State University.
