Michelle Choe

Michelle Choe represents and advises clients on a variety of intellectual property matters, with a specialty in copyright, music, entertainment, and technology. Her practice includes litigation and counseling, as well as licensing and other commercial transactions.

Prior to joining the firm, she served as an attorney-advisor and an inaugural Barbara A. Ringer Copyright Honors Fellow at the U.S. Copyright Office, assisting on intellectual property litigation pending before the Supreme Court, advising Congress on copyright and other intellectual property issues, conducting rulemaking proceedings, and shaping policy through comprehensive reports studying emerging copyright issues.

Representative Matters :

• Represented a nationally recognized, child-focused advocacy group in a copyright infringement case filed in the Eastern District of New York.
• Advised the U.S. government on complex litigation pending before the Supreme Court, on questions such as the copyrightability of software APIs, the legal standard for fee-shifting in copyright law, and the appropriate calculation of damages for the infringement of design patents.
• Advised Congress on developing issues at the intersections of copyright law, software and apps, the Internet, and music.
• Conducted the Section 1201 rulemaking proceeding concerning the Digital Millennium Copyright Act’s anti-circumvention provisions and drafted regulations adopted by the Librarian of Congress.
