Patricia L. Maher focuses on general commercial litigation and brings extensive experience in private practice and government service to representing clients in litigation on a variety of issues, including commercial disputes, professional liability issues, and matters involiving government regulations.

Trish has been counsel or co-counsel to a major accounting firm on more than 20 cases in state and federal courts around the country involving claims of professional negligence, fraud, breach of contract, fiduciary duty and RICO claims, based on the development and implementation of various tax strategies. She has also been involved in a promoter penalty audit, summons responses, IDRs, and privilege reviews of tax advice.

She has successfully tried claims in arbitration for both claimants and respondents.

  • She defended a Swedish company in arbitration against claims of breach of contract and antitrust conspiracy following the sale of a business, which resulted in no recovery for the claimant and award of costs to respondent.
  • She successfully pursued a claim by health care product distributor against a generic drug manufacturer for indemnification of potential joint and several liability on product liability claims valued at $200 million.

From 1998–2000, Trish served as a Deputy Assistant Attorney General in the Civil Division of the U.S. Department of Justice where she worked with the Offices of Consumer Litigation and Immigration Litigation. With OCL she collaborated with the Food and Drug Administration Office of Chief Counsel in bringing civil penalty and injunctive proceedings under the Food Drug & Cosmetic Act, as well as prosecuting criminal violations of the FDCA.

She also worked on litigation for the Bureau of Consumer Protection of the Federal Trade Commission and the Consumer Product Safety Commission. With OIL, she represented the United States on immigration matters in federal district court litigation and on appeals to the federal circuit courts from decisions of the Board of Immigration Appeals.
