Robert F. McCauley, managing partner of the firm’s Palo Alto office and co-leader of the trade secret litigation group, is an experienced trial attorney practicing patent, trade secret, and trademark litigation.
A former deputy district attorney, Rob has first chaired more than 30 jury trials and more than 50 bench trials. He has examined and cross-examined hundreds of witnesses in open court, and he regularly draws from those experiences when preparing clients for depositions and trial.
Since joining Finnegan in 2000, Rob has litigated cases spanning a wide range of technologies, including pharmaceuticals (Abbreviated New Drug Application (ANDA) litigation); medical devices; semiconductor devices, including flash memory; bicycle suspension systems and components; liquid cooling systems for data centers and computers; software; and optical networking.
He has extensive experience in developing explanations of technical and legal complexities in terms that judges and juries can understand. Before joining Finnegan, Rob served in the Domestic Violence Unit in the Santa Clara County District Attorney’s Office, which required frequent and challenging cross-examinations of uncooperative witnesses in open court.
Rob has been recognized by The Legal 500 U.S. for patent litigation, and has litigated before numerous U.S. district courts, the U.S. International Trade Commission (ITC), the U.S. Court of Appeals for the Federal Circuit, Patent and Trial Appeal Board (PTAB), and the Superior Court of California.
Rob regularly speaks at legal seminars regarding intellectual property trials and litigation, and has lectured at The University of California (Boalt Hall School of Law and Hastings College School of Law) and Santa Clara University School of Law.
Rob has also taught trial techniques for a course at Santa Clara University School of Law. Most recently, he served on the faculty of the National Trial Advocacy College at the University of Virginia School of Law, teaching advanced trial advocacy skills to experienced lawyers.
